Питання оподаткування інвестиційного прибутку було особливо актуальним у 2012 році у зв’язку із прийняттям Методики визначення інвестиційного прибутку професійним торговцем цінними паперами при виконанні функцій податкового агента (надалі - Методика). Здавалося, ніби прийняття спеціалізованого документа мало б розставити всі крапки над «і» в цьому питанні. Проте двозначностей та складностей законодавцеві уникнути не вдалося і у цьому випадку, і нині можна з впевненістю стверджувати, що по деяким питанням обліку звітності  та оподаткування інвестиційного прибутку існує суперечлива практика правозастосування, а окремі питання регулюються по-різному різними нормативно-правовими актами. Зрозуміло, що це м’яко кажучи не сприяє розвиткові фондового ринку, який і так нині зіштовхнувся з низкою проблем..
